1. Introduction

Welcome to Artdeco Inc. (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your use of our website located at https://artdecoinc.ca/ (the “Site”) and our laser engraving, cutting, and customization services (collectively, the “Services”).

By accessing or using our Site and Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site or use our Services.

2. Services and Custom Orders

Artdeco Inc. specializes in professional laser engraving, cutting, and personalized gifts.

• Accuracy of Information: When placing a custom order (e.g., for engraved pens, jewelry, or plaques), you are responsible for ensuring that all spelling, grammar, and design details provided to us are correct. We are not responsible for errors in the final product caused by incorrect information provided by you.
• Right to Refuse: We reserve the right to refuse to engrave any content that we deem offensive, illegal, infringing on intellectual property rights, or otherwise inappropriate.

3. User Accounts

To access certain features of the Site, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payment and Billing

By providing a credit card or other payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and shipping charges).

5. Returns and Refunds Policy

• Customized Items: Due to the personalized nature of our services (laser engraving and custom cutting), all sales of customized products are final. We do not accept returns or offer refunds for customized items unless the product is defective or we made an error in the engraving process that differs from the specifications you provided.
• Non-Customized Items: If you purchase non-customized stock items, you may contact us within 14 days of receipt to request a return, subject to a restocking fee.
• Reporting Issues: If you receive a defective or incorrect item, please contact us at artdecoinc.ca@gmail.com within 48 hours of delivery with photos of the issue.

6. Intellectual Property

• Our Content: The Site and its original content, features, and functionality are and will remain the exclusive property of Artdeco Inc. and its licensors.
• User Content: By submitting text, images, or designs for engraving, you grant Artdeco Inc. a non-exclusive license to use, reproduce, and modify such materials solely for the purpose of fulfilling your order. You represent and warrant that you own or have the necessary rights to any content you submit for engraving.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Artdeco Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
